Terms of service.

OUR RIGHT TO REJECT YOUR PURCHASE OR CANCEL AN ORDER Sale of products and fulfillment of orders at NylieCo is subject to availability and our discretion in managing inventory. We reserve the right to limit, decline or reject any sales and orders for any reason, without liability beyond refunding amounts received, in situations including but not limited to:

  • Events Outside Our Control (as defined below);

  • Product unavailability or out of stock status;

  • Incorrect or unverifiable billing information or payment method;

  • Orders flagged as potentially fraudulent or placed using automated ordering software;

  • Evidence of purchase for resale, tax evasion, or other fraudulent purposes;

  • Orders flagged for freight forwarding or shipping to addresses enabling tax avoidance;

  • Purchases exceeding product quantity or dollar amount limits;

  • Accounts showing excessive returns;

  • Evidence of purchase ineligibility;

  • Misspellings, pricing errors, or other mistakes on the NylieCo website or stores.

NylieCo will determine whether any of the above events have occurred in its sole discretion.

INDEMNIFICATION AND RELEASE You agree to indemnify, defend, and hold harmless NylieCo LLC, its affiliates, officers, directors, employees, agents, licensors and suppliers (the "NylieCo Parties") from and against all claims, losses, liabilities, expenses, damages and costs, including attorneys' fees, arising from or relating to your conduct in connection with any NylieCo store or with other NylieCo customers, or any violation of these Terms of Sale, any law or third party rights. You, for yourself and on behalf of your heirs, estate, insurers, successors and assigns, hereby fully and forever release and discharge the NylieCo Parties from any and all claims or causes of action for damages arising from or relating to your conduct in connection with any NylieCo store or with other NylieCo customers, or any violation of these Terms of Sale, any law or third party rights.

DISCLAIMER OF WARRANTY

NylieCo provides access to NylieCo popup stores "as is" and "as available", without any representation or warranty of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title or non-infringement. All such representations and warranties are hereby disclaimed. Without limiting the foregoing:

  1. NylieCo disclaims any warranties for products and their accuracy, including pricing, quantity and sizing

  2. NylieCo does not warrant that store information is accurate or that digital stores will operate without interruption or defects

  3. This disclaimer is enforceable to the fullest extent permitted by law and does not apply to warranties expressly offered by NylieCo or third-party manufacturers

DISPUTES

Choice of Law, Jurisdiction, Time Limit

These Terms and disputes shall be governed by Nevada law, without regard to choice of law provisions. Disputes shall be resolved individually in Nevada state or federal courts. You waive defenses of "lack of jurisdiction" and "inconvenient forum". Claims must be brought within three months unless longer required by law.

Right to Assign, No Waivers, Severability

NylieCo may assign these Terms to any party. You may only transfer rights with written consent. NylieCo's failure to enforce Terms is not a waiver. Invalid provisions do not affect other Terms' enforceability.

PRICE/PAYMENT

Payment Methods Accepted payment methods are listed at checkout on digital stores and registers. Gift card use is subject to NylieCo Gift Card Terms. NylieCo is not liable for attempted use of non-approved payment methods.

Payment Processing For non-custom orders, credit/debit payments are pre-authorized at order placement and charged at shipping.

Prices and Currency Prices exclude sales tax. Shipping rates apply per order. All prices are in US dollars and may change, but confirmed order prices are final.
